Terms of Service

These Terms of Service ("Terms") form an agreement between you and CardZap ("we", "us", "the app") and govern your use of the CardZap mobile application and related services. By downloading, installing, or using CardZap, you agree to these Terms. If you do not agree, please do not use the app.

1. Description of Service

CardZap provides AI-powered trading card recognition and pricing services. We use computer vision to identify cards from photos and provide estimated market values based on recent public sales data.

2. Subscriptions, Auto-Renewal, and Cancellation

CardZap is free to download. Free users receive a limited number of card scans per day. CardZap Pro subscriptions provide unlimited scans and additional features.

Subscriptions are sold and billed through Apple's In-App Purchase system and are charged to your Apple ID at confirmation of purchase.
Subscriptions automatically renew at the end of each billing period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
You can manage and cancel your subscription at any time in Settings → [your name] → Subscriptions on your iPhone or iPad, or at apps.apple.com/account/subscriptions. Cancellations take effect at the end of the current billing period; no partial refunds are provided for unused portions of a term.
Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.

This agreement constitutes the End User License Agreement (EULA) for CardZap Pro subscriptions on Apple platforms.

3. Pricing Information Disclaimer

Card prices shown in CardZap are estimates derived from recent eBay sold listings and other public market data, and should be used as a reference only. Actual card values vary based on condition, grading, market conditions, demand, and other factors. We do not guarantee the accuracy, completeness, or timeliness of any pricing information, and CardZap should not be relied on as financial or investment advice.

4. Acceptable Use

You agree to use CardZap only for lawful purposes and in accordance with these Terms. You agree not to:

Use the service to engage in fraud, misrepresentation, or any unlawful activity.
Attempt to reverse engineer, decompile, or extract the source code of the app, except where permitted by law.
Interfere with or disrupt the service, our servers, or any networks connected to the service.
Use automated systems (bots, scrapers) to access the service or to submit excessive scan requests.
Upload images that infringe intellectual property rights or that contain unlawful, harmful, or offensive content.

5. Intellectual Property

CardZap, including its software, designs, logos, and content (excluding user-submitted images), is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, in accordance with these Terms and the Apple App Store Terms of Service.

You retain ownership of card images you capture or import. By using the app, you grant us a limited license to process those images solely for the purpose of providing card recognition and pricing results to you, as described in our Privacy Policy.

6. Third-Party Services

CardZap relies on third-party services to function, including Apple In-App Purchase, RevenueCat (subscription management), OpenAI (image recognition), and the eBay API (public sold-listing data). Your use of the app is also subject to those providers' terms and privacy policies.

7. Disclaimers

CardZap is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that card identifications or pricing estimates will be accurate.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall CardZap, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the app — including, without limitation, any financial decisions made based on pricing information shown in the app. Our total liability for any claim arising out of or relating to the app shall not exceed the greater of (a) the amount you paid us for the app in the 12 months preceding the claim, or (b) USD $25.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Termination

We may suspend or terminate your access to the app at any time if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, third parties, or the service itself. You may stop using the app at any time by uninstalling it; cancelling an active subscription is handled through Apple as described above.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated in the app or by other reasonable means. Your continued use of the app after updated Terms become effective constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which CardZap is operated, without regard to its conflict of laws principles. Nothing in these Terms limits any non-waivable consumer rights you have under the laws of your country of residence.
